We are Embermont, trading as Embermont. We operate embermont.store and the related services that link to these terms.
Embermont is an e-commerce store offering home and outdoor products to customers in the United States.
These terms form a binding agreement between you and Embermont covering your access to the site and anything you buy from us. By using the site or placing an order, you confirm you've read and agree to them.
The services are intended for people aged 18 and over.
We may update these terms by posting changes to this page, with the date above revised. Changes don't apply retroactively to orders already placed.
We recommend saving a copy for your records.

Our store runs on Shopify Inc., which provides the e-commerce platform and hosting. Your purchase contract is with Embermont; Shopify is not a party to it.
2. Using our site
Information on the site isn't intended for use in any jurisdiction where that would be unlawful or would require us to register there. If you access the site from outside the United States, you do so on your own initiative and are responsible for complying with local law.
You may access the site and download or print content for your own personal, non-commercial use.
An account isn't required — guest checkout is available. If you create one, the login is yours to protect, and activity under it is your responsibility.
You confirm that you have the legal capacity to agree to these terms, that you're at least 18, that you won't access the site through bots or scripts, and that your use will comply with applicable law.
Where information you provide is false, inaccurate or incomplete, we may suspend or close your account and decline future orders.
3. Products
We make every effort to display colors, features, specifications and details as accurately as possible. Appearance varies with your device's display settings, and dimensions are approximate unless stated otherwise.
Availability changes and we can't guarantee that every product will always be in stock. We may discontinue a product at any time.
Obvious pricing and typographical errors are not binding on us. Where an error affects your order, we'll contact you and you may proceed at the corrected price or cancel that item for a full refund.
4. Prices and payment
All prices are shown in US dollars. Applicable sales tax is calculated at checkout based on your shipping address, and the total displayed at checkout is the total you pay — nothing further is collected on delivery.
Payment is taken when you place your order, using the methods shown at checkout. Payments are processed by a PCI-DSS compliant provider, and we don't store full card details.
By placing an order you authorize us to charge your chosen payment method for the total amount due. You agree to keep your payment and contact details current.
We may refuse an order, or limit quantities per person, household or order — including orders using the same account, payment method, billing address or shipping address. We may also limit orders that appear to come from dealers, resellers or distributors.
If a payment is declined or reversed, we may cancel the order.
5. Orders and shipping
Submitting an order is an offer to buy. The contract is formed when we confirm shipment.
Processing and delivery timeframes are set out in our Shipping Policy, which forms part of these terms.
Risk of loss passes to you on delivery — not when the package is handed to the carrier. If your order arrives damaged or doesn't arrive at all, contact us and we'll resolve it.
Delivery estimates are estimates. We're not liable for delays caused by carriers, weather or other events outside our control, though we'll help you trace a delayed package.
Where we can't ship within the stated timeframe — or within 30 days if no timeframe was given — we'll notify you and you may choose to wait for a revised date or cancel for a full refund.
6. Returns
Returns are governed by our Return Policy, which forms part of these terms. In summary: 30 days from delivery, and full conditions are set out there.
Cancellations: you may cancel free of charge any time before your order ships. Email us with your order number as soon as you can.
7. Defective, damaged or incorrect items
If a product arrives with a manufacturing defect, is damaged in transit, or isn't what you ordered, contact us within 30 days of delivery with your order number and, where possible, photographs.
We'll send a replacement or refund you in full — whichever you prefer.
This doesn't limit any rights you have under applicable consumer protection law, including implied warranties of merchantability and fitness for a particular purpose where those apply.
8. Product safety and intended use
Products should be used only for their intended purpose and in accordance with any instructions, warnings or age guidance supplied with them.
Where a product carries manufacturer instructions or safety information, please read it before use. We're not responsible for injury, loss or damage resulting from misuse, modification, or failure to follow those instructions.
Outdoor products vary in how they handle weather. Where a product needs covering, storing or particular maintenance, that's noted on the product page.
9. Intellectual property
We own or license all intellectual property in the site, including source code, databases, software, design, text, images, audio, video and graphics, together with our trademarks, service marks and logos.
Content and marks are provided on an "as is" basis for your personal, non-commercial use.
Except as these terms permit, no part of the site may be copied, reproduced, republished, uploaded, posted, displayed, translated, transmitted, distributed, sold or licensed for commercial purposes without our prior written permission.
To request permission beyond what's granted here, email support@embermont.store. Where permission is given, please credit us and keep all copyright notices visible.
10. Reviews and submissions
You retain ownership of anything you submit. By sending us a review, photograph, suggestion or comment, you grant us a perpetual, worldwide, non-exclusive, royalty-free, transferable and sublicensable license to use, reproduce, modify, translate, publish, distribute and display it in any media.
We're not obliged to keep submissions confidential, to compensate you, or to respond.
By posting a review you confirm that it reflects your genuine experience, contains no offensive, abusive, discriminatory or unlawful language, doesn't promote illegal activity, and isn't posted on behalf of a competitor.
You also confirm that anything you submit is your own or shared with permission, doesn't infringe anyone's intellectual property, privacy or publicity rights, contains no false or misleading claims, and includes no spam or malicious code.
We may accept, decline or remove any submission at our discretion, though we're not obliged to monitor them. Reviews reflect the views of their authors, not ours.
11. Prohibited activities
You may not use the site to break any law, defraud or mislead us or other users, harass or abuse anyone, or infringe intellectual property rights.
You also may not:
- Systematically collect data or content to build a database or directory
- Circumvent, disable or interfere with security features
- Upload viruses, malware, spam or other harmful code
- Use bots, scrapers, spiders or data-mining tools, except standard search engine indexing
- Remove copyright, trademark or proprietary notices
- Impersonate another user or use someone else's account without authorization
- Upload spyware, web bugs or tracking mechanisms
- Interfere with or disrupt the site, its servers or connected networks
- Harass or abuse our staff
- Attempt to bypass security or access restrictions
- Reverse engineer, decompile or disassemble any part of the site, except where the law permits
- Use purchasing agents or automated systems to place orders
- Create accounts by automated means or harvest email addresses
- Use the site for any unauthorized commercial purpose
We may restrict, suspend or terminate access where these terms are breached.
12. Third-party websites and content
The site may link to third-party websites or display third-party content. We don't investigate, monitor or verify their accuracy, and their inclusion isn't an endorsement.
We're not responsible for the content, privacy practices, products or services of any third-party site. Purchases made through them are between you and that third party.
13. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these terms.
Our platform provider processes and stores data in the United States and other countries. The Privacy Policy explains what that means for your information.
14. Site availability
We may modify, update, suspend or discontinue any part of the site at any time.
We can't guarantee uninterrupted availability. Maintenance, technical issues, hardware failures and other circumstances may cause interruptions or delays.
Nothing in this section affects an order we've already accepted.
15. Termination
These terms remain in effect while you use the site.
Where we reasonably believe you've breached them or applicable law, we may suspend or terminate your access. Orders already confirmed will still be fulfilled, and amounts owed remain payable.
If your account is terminated, please don't register a new one under a different name.
16. Corrections
The site may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing or availability.
We may correct these and update or cancel affected orders, including after you've placed one. Where we cancel for this reason, we refund in full.
17. Disclaimer and limitation of liability
The site is provided on an "as is" and "as available" basis, and your use of it is at your own risk.
To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee the accuracy, completeness or reliability of the site or any linked third-party website.
Our total liability arising from any order is limited to the amount you paid for that order. We're not liable for indirect, incidental, consequential, special or punitive damages, including lost profits, lost revenue, lost data or business interruption.
Nothing in these terms limits liability for fraud, for personal injury caused by our negligence, or for any liability that cannot legally be excluded. Some states do not allow the exclusion of implied warranties or the limitation of certain damages, so parts of this section may not apply to you.
18. Indemnification
You agree to defend, indemnify and hold harmless Embermont and its affiliates, officers, employees, agents and representatives from any claim, damage, liability, loss, cost or expense — including reasonable attorneys' fees — arising from your use of the site, your breach of these terms, or your violation of any law or third-party right.
We may assume the exclusive defense of any such matter at your expense, and you agree to cooperate. We'll make reasonable efforts to notify you of a claim covered by this section.
19. Electronic communications
By using the site, emailing us or submitting online forms, you consent to receiving communications electronically, and you agree that electronic notices, agreements and records satisfy any legal requirement that they be in writing.
You also consent to the use of electronic signatures and records.
20. Complaints and disputes
If something goes wrong, contact us first at support@embermont.store. We respond within 2 business days and make reasonable efforts to resolve complaints directly.
Where a dispute can't be resolved informally, both parties agree to allow at least 30 days from written notice before commencing proceedings.
Any action that can't be resolved that way will be brought before the state or federal courts located in Sacramento County, California, and both parties consent to that jurisdiction.
Nothing here prevents you from bringing a claim in small claims court, or from exercising any right you have under the consumer protection laws of your own state.
California residents: if a complaint isn't resolved to your satisfaction, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834.
21. General
These terms, together with our Return Policy, Shipping Policy and Privacy Policy, form the entire agreement between us.
Our failure to enforce a provision isn't a waiver of it. If any provision is found unlawful or unenforceable, it's severed and the rest remain in force.
We may assign our rights and obligations under these terms. We're not responsible for delay or failure caused by circumstances beyond our reasonable control.
Nothing in these terms creates a partnership, joint venture, employment or agency relationship, and they won't be interpreted against either party simply because that party drafted them.
